Fernando Castro Silva Cavalcante
Founding partner with more than 26 years of experience in corporate law and intellectual property.
His experience prior to founding FCSC Advogados includes Arthur Andersen, Ernst Young and large law firms, such as Mattos Filho, Veiga Filho, Marrey Jr e Quiroga Advogados and Dannemann, Siemsen, Bigler & Ipanema Moreira. He also managed legal departments of domestic and international companies. Fernando knows the corporate environment inside out, which gives him a singular perspective to resolve his clients most complex demands.
Fernando Cavalcante advises technological innovation and biotechnology companies, as well as start-ups on intellectual property and contract matters. He litigates disputes directly and indirectly related to corporate law and other areas of law. He provides strategies on technological innovation management and represents clients on administrative and court proceedings. He has broad experience in negotiations, arbitrations and domestic and international contracts. His expertise includes counselling companies in all matters related to biotechnology, patents, trademarks, software, cultivars and technology transfer.
He is one of the specialists with the Domain Names Disputes Solution Chamber (CASD-ND) and an arbitrator at the Arbitration Chamber (CARB-ABPI) of the Brazilian Intellectual Property Association. He also serves as an arbitrator for the Brazilian Franchising Association, which is associated with the Brazilian Intellectual Property Association.
His work spans corporate positions including managing agribusiness and ceramic companies and advising their legal departments.
He was a legal counsel for “CAT” / “CEPID” (Applied Toxinology and Research Centre for Innovation and Dissemination) of “FAPESP” (São Paulo Support Research Foundation) for issues related to contracts and intellectual property. Currently, he serves as a director for agribusiness and ceramic companies advising their legal departments.
Fernando is a regular speaker on issues related to Intellectual Property and Biotechnology at the UNIMEP Institute, Butantan Institute, different universities in Brazil and at the International Intellectual Property Committee of the Brazilian Intellectual Property Association.

Raphael Leal Giusti
Raphael counsels clients on tax implications of intellectual property matters. He has experience in economic and administrative law issues and assists clients on tax planning for intangible assets. He has worked for the Municipal Urbanization Company of São Paulo (“EMURB/SP”) and was a Tax Court Judge in São Paulo from 2000 to 2005. He also worked as a legal manager for a large corporation and as a tax lawyer in specialized tax law firms. He was a teacher for the government of the State of Amapá on matters related to public biddings.
